okVibe — Daily Wellbeing Check-In for Independent Living

1. Acceptance

By downloading, installing, accessing, or using okVibe (the "Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy, incorporated by reference.

If you do not agree, do not use the Service.

These Terms are a legally binding agreement between you and ICI Tech Teknoloji A.Ş. ("Company", "we", "us", "our"), registered in Turkey.

To use the Service as a Primary User, you must:

• Be at least 18 years of age
• Be capable of forming a legally binding contract
• Not be prohibited from using the Service under applicable law

An account is required for the Primary User. Trusted Contacts do not need an account.

4. Account Registration

An account is required for Primary Users. You agree to:

• Provide accurate, current, and complete registration information
• Keep your credentials confidential and not share them
• Notify us at app@icitech.com.tr of suspected unauthorized access
• Accept responsibility for all activity under your account
• Maintain only one account (creating multiple accounts to abuse free trial benefits is prohibited)

5. Free Trial

We may offer a free trial of okVibe Premium. The following applies:

• Available to new subscribers only (one per Apple ID or Google account)
• Trial length is stated clearly before activation
• Payment method required via App Store or Google Play
• Not charged during trial
• Automatically converts to paid subscription at trial end unless cancelled beforehand

How to cancel before being charged

Deleting the app or contacting us does not cancel a trial. Cancel through the App Store or Google Play.

6. Subscriptions and Billing

okVibe Premium is an auto-renewing subscription through the Apple App Store (iOS) or Google Play (Android).

• Billed in advance on a recurring basis (monthly or annually)
• Renews automatically unless cancelled before the renewal date
• Renewal charged within 24 hours before period end
• We do not process payments directly and never receive your card details
• We use RevenueCat for subscription state management only
• Prices shown in your local currency at purchase; taxes determined by Apple or Google

7. Cancellation and Refunds

Cancellation

Cancellation takes effect at end of current billing period. Premium access continues until then.

8. What okVibe Is and Is Not

What okVibe IS

okVibe is a daily check-in companion for independent living designed to:

• Give you a simple daily routine to confirm you are okay
• Alert only your chosen trusted contacts if you miss a check-in
• Provide gentle reminders without surveillance or intrusion
• Offer an optional SOS location-sharing feature you can enable
• Keep a check-in history for your own reference

What okVibe IS NOT

okVibe is not:

• An emergency service or substitute for calling emergency services
• A medical device, fall detector, or health monitoring system
• A crisis hotline or mental health service
• A guaranteed safety system or continuous monitoring platform
• A location tracker (GPS is not used in the routine check-in flow)
• A replacement for professional care or clinical assessment

In immediate danger, call your local emergency services (e.g. 112, 999, or 911).

9. Safety Disclaimer

Please read this section carefully.

okVibe provides no guarantee of safety outcomes. Check-in alerts depend on:

• Your device being charged and connected to the internet
• Notification delivery by your device, carrier, and OS
• Your trusted contacts receiving, reading, and acting on alerts
• Correct app configuration by you

We are not liable for missed alerts due to technical failure, network issues, device problems, or failure of trusted contacts to respond. okVibe is a supplementary reassurance tool — it does not replace emergency services, professional care, or other safety measures.

Trusted contacts are not obligated to respond to missed check-in alerts. okVibe does not verify that trusted contacts are available, trained, or capable of providing assistance.

10. Location and SOS Features

The core check-in routine does not use GPS or location data. This is a fundamental design principle of okVibe.

Location data is only processed when you explicitly enable the optional SOS feature:

• You must actively enable SOS and grant location permission
• Location is shared with your trusted contacts only while SOS is active
• Disabling SOS or revoking location permission immediately stops location sharing
• We do not store location data beyond what is necessary to deliver SOS alerts

By enabling SOS, you consent to the collection and sharing of your location with your configured trusted contacts for the duration the feature is active. You may withdraw this consent at any time by disabling SOS in the app or revoking location permission in device settings.

11. Trusted Contacts — Your Responsibilities

When you add someone as a trusted contact, you:

• Confirm you have their consent to receive missed check-in notifications from okVibe
• Accept responsibility for ensuring the contact details you provide are accurate
• Understand that trusted contacts will receive alerts (and location if SOS is active) based solely on your configuration
• Can remove trusted contacts at any time in Settings → Trusted Contacts

okVibe notifies trusted contacts as instructed by you. We are not responsible for how trusted contacts respond to, interpret, or act on alerts.

12. Acceptable Use

Use the Service for lawful, personal check-in and reassurance purposes in accordance with these Terms.

13. Prohibited Conduct

You agree not to:

• Create an account if under 18
• Create multiple accounts to abuse free trial benefits
• Add trusted contacts without their knowledge or consent
• Reverse engineer, decompile, or extract source code from the Service
• Use automated tools to interact with or scrape the Service
• Introduce malware or interfere with the Service's infrastructure
• Resell, sublicense, or commercially exploit the Service
• Use the Service in violation of applicable law or in a way that could harm others

14. Intellectual Property

All Company Content — including the okVibe name, logo, app design, check-in flow, and software — is owned by or licensed to ICI Tech Teknoloji A.Ş.

You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes.

Feedback you submit grants us a perpetual, royalty-free licence to use it without obligation or compensation.

15. Your Content and Data

You own your check-in data, status notes, and check-in history. You grant us a limited licence to store and process this data solely to provide the Service to you.

You are responsible for the accuracy of trusted contact information you provide.

16. Privacy

Your use is governed by our Privacy Policy. For EEA/UK users, our GDPR Privacy Notice also applies.

Key commitments: no GPS routine tracking, no data selling, trusted contacts notified only as configured, no advertising data use.

17. Third-Party Services and Platforms

Apple App Store (iOS)

• These Terms are between you and ICI Tech Teknoloji A.Ş. — not Apple
• Apple has no obligation to maintain or support okVibe
• Apple and its subsidiaries are third-party beneficiaries of these Terms

Google Play (Android)

Google Play is not a party to these Terms.

RevenueCat

Manages subscription state only. Does not receive check-in data, trusted contact data, or location. Privacy: https://www.revenuecat.com/privacy

18. Availability and Changes

• We aim for continuous availability but do not guarantee uninterrupted access
• The Service requires an internet connection for check-in alerts and notifications
• We may modify, suspend, or discontinue any feature with reasonable notice
• We are not liable for interruptions outside our reasonable control

19. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, including:

• That alerts will always be delivered reliably
• That trusted contacts will receive, read, or respond to alerts
• That the SOS feature will function in all circumstances
• That use of the Service guarantees any safety outcome
• Uninterrupted or error-free operation

20. Limitation of Liability

To the maximum extent permitted by applicable Turkish law, ICI Tech Teknoloji A.Ş. and its officers, employees, and partners shall not be liable for:

• Any failure of check-in alerts to be delivered or acted upon
• Any harm, injury, or loss resulting from a missed check-in or failure of the SOS feature
• Indirect, incidental, special, consequential, or punitive damages
• Any damages exceeding the greater of (a) the amount paid in the twelve months preceding the claim, or (b) ₺500

Nothing limits liability for death or personal injury caused by gross negligence, fraud, or any liability that cannot be excluded under mandatory Turkish law.

21. Indemnification

You indemnify ICI Tech Teknoloji A.Ş. against claims arising from: your violation of these Terms, adding trusted contacts without consent, your misuse of SOS features, or your breach of applicable law.

22. Termination

By you

Delete your account via Settings → Account → Delete Account. Cancel your subscription first via App Store or Google Play — deleting the account does not cancel the subscription.

By us

We may suspend or terminate accounts for breach of these Terms, legal requirements, or to protect the Service.

Effect

Your licence ends immediately. Sections 8, 9, 14, 19, 20, 21, and 23 survive termination.

23. Governing Law and Disputes

Governed by the laws of the Republic of Turkey, including the Turkish Code of Obligations and Law on Consumer Protection No. 6502.

Disputes subject to the jurisdiction of Istanbul (Çağlayan) courts, subject to mandatory EEA/UK consumer protection rights below.

EEA and UK consumers retain the protections of their mandatory local consumer protection laws, which cannot be waived.

24. Changes to These Terms

Material changes notified at least 14 days in advance. Current version at /en/terms.

25. Miscellaneous

• Entire agreement: These Terms and Privacy Policy constitute the entire agreement.
• Severability: Invalid provisions severed; remainder continues.
• Waiver: Non-enforcement is not a waiver.
• Assignment: You may not assign without written consent; we may assign freely.
• Force majeure: No liability for events beyond our reasonable control.
• Language: English version prevails over translations.
